TERMS AND CONDITIONS
In these Terms and Conditions, “we”, “us”, and “our” refer to “Gallery Can Boni SL”, and “you” refers to the customer. These terms and conditions of purchase (hereinafter the “General Conditions”) govern the legal relationship that arises from the purchase and sale processes carried out by you on the website located at the URL www.gallerycanboni.com and the owner of the same, Gallery Can Boni SL, with CIF B16597221, located at C/ Can Boneo 2A, 07012 Palma de Mallorca, Islas Baleares, España. You accept the General Conditions from the moment you use or contract the service or acquire any product. This document can be printed and stored by you. Gallery Can Boni SL provides you with the email address info@canboni.com, so you can ask any questions about the General Conditions.
1. PLACING YOUR ORDER
1.1. To place an order, you must be 18 years old and have the capacity to contract. You declare that the data and information you provide us are truthful and up-to-date.
1.2. You can place the order through our online store at www.gallerycanboni.com. Orders that arrive in a different way than indicated will not be accepted.
1.3. By placing your order, you are making us an offer to purchase the products you have selected in accordance with these General Conditions.
1.4. Once your order is accepted, we will send you a confirmation by email where the order number will also be stated. The order confirmation will be effective from its sending. If we cannot process your order due to an incident, we will contact you by email or phone.
1.5. To place an order through the Gallery Can Boni SL website, you need internet access to connect to www.gallerycanboni.com. You need to register as a user by filling out the electronic form before starting the purchase process. Once registered, you can proceed with the purchase of the product or products added to the basket or browse the web to add new products to it.
1.6. Once registered and having all the required products in the basket, the purchase is continued, reaching the screen for selecting Payment Methods, Shipping Methods, and Modification (if required) of billing and/or shipping data.
1.7. Once the purchase has been made and as quickly as possible, within reason, Gallery Can Boni SL will send customers an email with the order receipt containing the purchase summary, as well as payment information if applicable, and shipping and billing data.
1.8. The product or products will be sent according to the shipping method selected by you.
2. SUPPLY OF YOUR ORDER
2.1. We will supply you with the products selected in the confirmation of your order, in accordance with these General Conditions.
2.2. The order reception schedule is twenty-four (24) hours, three hundred and sixty-five (365) days a year. However, orders placed after 20:00 will be processed the next business day in the city of Palma de Mallorca. Orders received during the weekend will be processed first thing the following Monday or the next business day.
3. PRICES
3.1. The price of the products includes the corresponding VAT and will be the one indicated in your order and/or invoice. The payment of VAT will be charged to the customer.
3.2. VAT will not be applied to the purchase of products whose destination is outside the European Union. In addition, intra-community acquisitions made by a company/professional will be exempt from VAT as long as the buyer proves their professional status or their tax identification appears in the VIES system of the European economic community, which can be verified through the page: http://ec.europa.eu/taxation_customs/vies/vieshome.do?locale=en
3.3. Shipping costs are charged to the customer, as indicated in your order and invoice.
3.4. In shipments to the Canary Islands, Ceuta, and Melilla, the customer, upon receiving the product, will bear the costs of customs clearance, as well as the payment of the local tax, IGIC, or similar.
3.5. In shipments to countries not belonging to the European Union or with which the European Union does not have a customs suppression agreement, the customer will bear the costs of customs clearance and other applicable taxes upon receiving the product.
4. PAYMENT OF YOUR ORDER
4.1. You can pay for your products by the payment systems that appear in the payment methods section of our online store.
4.2. We only accept payments in Euros.
4.3. If you pay with a credit card, you must provide your credit card details at the time of placing your order. We only accept payments with secure cards in which your identity as the cardholder is authenticated according to the method established by your bank, through the secure e-commerce service (“Verified by Visa” and “MasterCard SecureCode”).
4.4. If you pay by bank transfer/account deposit, we will send you a payment request by email. Your order will not be reserved or sent until we have received the payment in our bank account. If we do not receive the full payment within seven (7) days of the date of your order, it may be canceled. In any case, once you have made the payment by transfer or deposit into the account, you must immediately send us proof of it as well as your order number to the following email address: info@canboni.com. Sending the transfer receipt could speed up the process, but in no case would it validate it or reserve it.
5. DELIVERY OF YOUR ORDER
5.1. We will send your order to the shipping address that appears in your order request.
5.2. Orders are sent insured, with a policy that covers the replacement value of the purchased works.
5.3. We will send your order within the shipping period that appears on our website on the date of issue of your order confirmation. If you have requested several products in the same order, we may deliver them on different dates. You can cancel your order at any time before it is shipped by sending an email to info@canboni.com indicating your order number.
5.4. At the time of delivery of your order to the carrier, we will send you a shipping confirmation to the email address you have provided when placing the order. In the shipping confirmation, we will indicate the tracking number corresponding to your shipment so that you can track it through the carrier’s website.
5.5. Order processing will be carried out within 24 hours, excluding Saturdays, Sundays, and holidays in the autonomous community of Islas Baleares.
5.6. Ownership and the risk of loss of the products of the order will be transferred to you when the order is delivered to you.
5.7. In the case of shipments to the Canary Islands, Ceuta, and Melilla, as well as other destinations where customs control must be passed, the costs of customs clearance, as well as the payment of the local tax, will always be borne by you. In the event that you reject the order at the time of delivery and it is returned to Gallery Can Boni SL by the transport company, the costs of customs, local tax, and shipping costs
incurred, as well as bank charges, if any, will be deducted from the purchase refund.
6. SATISFACTION OR RETURN. RIGHT OF WITHDRAWAL
6.1. If you are not satisfied with any of the products in your order, you may exercise the right of withdrawal and request a return, within a maximum period of fourteen (14) natural days following the receipt of the order, to obtain a refund of the product(s).
6.2. In order to exercise the option to return an order/product, you must send an email to info@canboni.com, attaching the invoice number and the order number, and including your contact details, so that we can provide you with a return number and instructions on how to return the order/product.
6.3. You must return the products of the order in perfect condition, otherwise, the return will not be allowed. In addition, the transport of the returned order must be done under the same conditions as the delivery, and you are obliged to take out insurance that covers the replacement value of the returned work. The return shipping costs are borne by the customer.
6.4. In case of returning the order, the amount paid for the purchased work will be refunded, but excluding the shipping costs paid at the time.
6.5. In the case of returns from the Canary Islands, Ceuta, and Melilla, and other destinations where customs control must be passed, the return shipping costs, as well as the costs of customs clearance and local taxes, if any, will always be borne by the customer.
6.6. Without affecting the right of withdrawal of consumers or the warranty liability for defective products, the total liability of Gallery Can Boni SL for the supplied goods would be limited to the amount of the same.
6.7. When the product is defective from origin, you should send an email to info@canboni.com with the invoice number and explaining the defect. We will send you an email indicating how to send the defective product to Gallery Can Boni SL. Once the defective product has been received and checked, we will send another one in exchange at no additional cost (always subject to availability of the same). In this case, the change will be made for the same item or reference. Gallery Can Boni SL will bear the costs corresponding to the return and new shipment.
6.8. Those deteriorations attributable to the customer, such as neglect of the appropriate conservation measures of the work, exposure to light, water or other elements, influence of environmental and climatic conditions, improper use of the work and other similar factors, will not be considered defects of origin.
6.9. When the merchandise, by mistake, does not correspond to that of the order, Gallery Can Boni SL will bear the costs of collecting the wrong merchandise and delivering the one corresponding to the order made.
6.10. In case the order is a gift, Gallery Can Boni SL will change or refund the product if the return complies with the conditions described in the previous and following sections.
6.11. Orders with in-store pickup and direct purchases at the pickup point have a withdrawal period (return and/or exchange) of fourteen (14) natural days from the date of delivery.
6.12. In case of return, the refund of the amounts paid will be made through the payment method used in the purchase.
6.13. Gallery Can Boni SL will not refund the amount or make any reshipment of merchandise until it has verified the receipt and packaging status of the product subject to return. The amount to be returned is the one that originally appeared on the order, excluding the shipping costs of the first shipment.

8. CONTENTS AND INFORMATION PROVIDED ON OUR WEBSITE
8.1. Gallery Can Boni SL reserves the right to modify the commercial offer presented on the website www.gallerycanboni.com (modification of products, prices, promotions, and other commercial and service conditions) at any time.
8.2. Gallery Can Boni SL makes all reasonable means available to try to ensure that the information displayed on its website is truthful and without typographical errors. If any such error occurs, entirely beyond the will of Gallery Can Boni SL, it will be corrected immediately, as soon as it is detected. If the error occurs in some of the prices shown and a customer has made a purchase, we will communicate this error and the customer or user will have the right to cancel their order at no cost to them. The sending of an automatic purchase confirmation does not validate the conditions of an erroneous price.
8.3. The information presented on this website is in English. In case of discrepancy between the versions, the English version will prevail.

By placing an order, you agree that we may store, process, and use data obtained from your order form for the purposes of processing your order. By providing your email address or other personal data, a requirement necessary for the processing of your order, you give your permission for these addresses to be processed and also used to send commercial communications, promotions, newsletters, or advertising of the products offered by Gallery Can Boni SL. 10. FORCE MAJEURE
We will do everything possible to comply with the obligations arising from your order. However, we will not be responsible for delays or non-compliance if the delay or non-compliance is due to force majeure. In case of delay, we will fulfill our obligations as soon as it is reasonably possible.
11. APPLICABLE LEGISLATION AND COMPETENT JURISDICTION
Any controversy arising from the interpretation or execution of the contract will
be interpreted under Spanish law. In case of any conflict or discrepancy, the applicable jurisdiction will be that of the Courts or Tribunals of Palma de Mallorca, unless the applicable law provides otherwise.
